This website is operated by Pop Painted. Throughout the site, the terms “we”, “us”, and “our” refer to Pop Painted. Pop Painted offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms”), including any additional terms and conditions and policies referenced herein or available via hyperlink. These Terms of Service apply to all users of the site, including browsers, vendors, customers, merchants and/or contributors of content.

Our store is hosted on wix.com, they provide us with the online e-commerce platform that allows us to sell our products and services to you.
SECTION 1 - GENERAL INFORMATION & CONDITIONS
We reserve the right to refuse service to anyone, at any time, for any reason.
Original paintings: are one-of-a-kind pieces of art that have been hand-painted. The canvas material, using acrylic paint and/or other paint mediums, will have a textured finish.
Numbered Prints: This is a reproduction of an original piece of art using a high resolution image printed on quality print paper.
Commissions: A unique piece requested by an individual or business, with specifications and personalisation to fit a certain brief.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission from us.
We have made every effort to display as accurately as possible the colours and images of our products that appear within the store and across the website. We cannot guarantee that the colour displayed via your computer monitors and/or devices will be accurate.
You must not use our artwork or services for any illegal or unauthorised purpose. You agree not to transmit harmful code, viruses, or malware.
A breach of these Terms will result in immediate termination of services.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect the Terms.
SECTION 2 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or correct. The material on this site is provided for general information only and should not be relied upon or used as a sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only.
We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes on our site.
SECTION 3 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
All descriptions, products or product pricing are subject to change at anytime without notice, at our sole discretion. We are not liable for such charges.
We reserve the right to modify or discontinue any product at any time and to limit or refuse sales at our discretion.
Any offer for any product or service made on this site is void where prohibited.
SECTION 4 - PAYMENTS, BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse or cancel any order. If we change or cancel an order, we may attempt to notify you. You agree to provide accurate, current information and update it as needed.
Payments: We accept credit, debit cards, Apple and Google Pay for online orders. Commissions are subject to bank transfer, based upon ‘Commissions’ mentioned below within Terms and Conditions.
Commission deposits Are not refundable after 24 hours, or if the painting has not started, then you may be refunded part of the deposit, depending on material and administration costs incurred. This is the discretion of the artist.
SECTION 5 - ORDERS
Original and Limited numbered Prints only:

Order amendments after placement: We try our utmost to process and despatch orders as quickly as possible. However, if you decide you want to amend your order, please email us at info@pop-painted.com and we will ry our best to resolve your desired amendment. Order amendments are only subject to items which have not been despatched.

Order Confirmation: Once you have placed your order, you should receive an email confirmation at the email address provided to us when placing your order.

Order Status: Once your order has been placed, we will then email you to inform when your order has been despatched, along with any reference number (if available) and an expected delivery date.
Commission orders only:
All commissions are subject to a ‘Definition Contract’ which is concurred by the client and artist. Once concurred, in terms of a written agreement, a 50% deposit is required to secure the commission and for works to commence.
By paying the deposit based upon the agreed price between the artist and the client, the client is confirming that they have read and understand Pop Painted Terms and Conditions and Policies.
Acrylic commissions are painted to a ‘pop’ simplistic style unless otherwise stated. The client will be shown the commissioned piece at two stages of the development process - one at the pencil drawing concept and mid-stage of painting. It should be noted that this is not a professional scan of the image, but consideration will be taken for both quality and colour likeness. The image is shared via email, and we take no responsibility for the colour transposed via your computer monitor or device, as highlighted via SECTION 1 of these Terms and Conditions.
Within both development stages, feedback is welcomed, but the client will have one round of changes to suggest during the process (within stage one or two)- Subject to ‘Order amendments after placement’ noted below.
The artist will aim to achieve likeness based on the image provided and the detail within the reference photo in POP styling.
If the artist is required to create a design, merge multiple images into one piece or mock up a concept, additional fees will apply.
Images shared by the client should be of the highest quality and colour likeness, providing as much detail and definition for the artist to create the best possible art piece.
When the artist has completed the painting, the image will be shared with the client for review prior to shipment. Approval should be in the form of a written email.
If changes have already been made under the client's amendment request, further charges will be requested, along with any additional fees applied at an hourly rate of £50.
Once the commissioned painting is approved, the final balance, the remaining 50% of the invoice, is payable prior to shipment.
Payment must be received prior to items being despatched.
We will then email you to inform when your order has been despatched, along with any reference number (if available) and an expected delivery date.
Order amendments after placement: Changes will be allowed depending on the magnitude and may incur additional charges. The original concurred definition statement will require modification and is subject to written agreement.
If there is a change to the brief or a significant change to the concurred definition during the development process by the client The artist has the right to refuse or request additional fees to cover the labour time for modification (per hourly rate).
SECTION 6 - CANCELLING YOUR ORDER
ONLINE ORDERS: Original and Limited numbered Prints only
Under the consumer protection, you have the right to cancel your order until the point at which it is shipped. In order to cancel your order, you must first inform us by sending an email to info@pop-painted.co.uk. Please note that this must be within 48 hours of your purchase. Once this has been noted, you will then receive an email confirming your cancellation. You will then be refunded the full amount, including shipping charges, minus a £10 administration fee.
Commission orders only: If you wish to cancel your commission after completion (pre-delivery), then you will not receive a refund of the deposit unless the item is damaged. If the commission is not complete, you have the right to cancel your order, but the deposit is non-refundable, meaning 50% of the balance is paid. In order to cancel an order, you must first email your cancellation request to info@pop-painted.co.uk. Once this has been processed, you will then receive an email confirming your cancellation. The work will not be shipped in its current state, and the commission definition becomes void.
SECTION 7 - REFUNDS AND RETURNS
Due to the nature of the sale, the limited number of edition prints, Original Artworks, Commissions and exclusive stock, all sales are final. Once an order has been despatched, returns or refunds on any purchase are not accepted.
In the event the item is received defective or damaged in transit, please email info@pop-painted.com within 14 days of purchase. Photos will be required of the damage - artwork and packaging showing the date and time the image was taken.
SECTION 8 - POSTAGE AND PACKAGING
Original and Commission Paintings are shipped as a complete canvas; this means the painting will be shipped on the stretched wooden bars.
Limited Number Prints will be rolled and shipped in a tube.
We aim to be as sustainable as possible, and wherever we can, we will recycle packaging material.
All artworks will be securely packaged, and the surface will be protected by using acid-free tissue prior to additional protection layers being applied. These layers can include bubble wrap, cardboard sheets and/or foam inserts for rigidity, cushioning and shock absorption.
Corners will be protected using cardboard, corner protectors or folded bubble wrap, providing extra cushioning and protection for these vulnerable areas.
The outer packaging for Original paintings will be custom-made using sturdy materials, for example double-walled cardboard box.
Strong, heavy-duty packing tape will be used to secure all layers and the final box.
Each art piece will be shipped with a Certificate of Authenticity, stamped and signed by the artist.
Where applicable, Original Paintings and Limited numbered prints will also be shipped with a provenance providing the history of the piece and subject matter.
SECTION 9 - SHIPMENT AND DELIVERY COSTS
Original and Limited Numbered Prints: Shipping costs are calculated at checkout based on the size of the parcel and the address of the recipient.
If the piece is being shipped directly to a framer, kindly note within the ‘comments’ section upon purchase.
Commissions: Due to the design and painting process, the cost of shipment is provided upon completion of the commissioned piece.
If an estimate of the shipment cost is required upfront, kindly confirm during the commission consultation. The cost of the delivery estimate will be noted within the Contract Definition.
Note: Estimated delivery costs are subject to change.
If a commissioned piece is being shipped directly to a framer, confirmation is required during the commission consultation discussion for shipment and Contract Definition purposes.
All shipments are made promptly upon payment - typically within 3 days.
UK Shipping services are via Special Delivery methods.
International Shipping services are via a Tracking service.
All delivery items are insured for the value of the item purchased (less delivery costs) and is subject to a cost-efficient delivery provider.
A tracking/delivery reference number will be provided upon shipment via email/delivery notification.
If an alternative shipping option is preferred, please contact info@pop-painted.com to discuss; all alternative delivery costs are payable by the customer. Pop Painted take no responsibility for any alternative delivery option outside of the arranged delivery service defined within these terms.
International tax, import and customs charges are payable by the customer.
Pop Painted is not responsible for lost, mis-deliveries, missing deliveries, damaged parcels or responsibility upon receipt at a framing service.
All delivery charges are subject to change. Delivery charges are non-refundable.
